1. Introduction & Acceptance

Welcome to Pinporn.app ("Platform", "Service", "we", "us", "our"). These Terms of Service govern your access to and use of our adult-oriented social media platform, including all content, features, and services we offer.

By accessing or using Pinporn.app, you agree to:

False Age Attestation: Providing false information about your age is a violation of these Terms and may result in immediate account termination and legal action.

You retain all ownership rights to Content you upload to the Platform. However, by uploading Content, you grant us certain licenses as described below.

By uploading Content, you represent and warrant that:

• Original or Licensed: You own the Content or have obtained all necessary rights and licenses to upload and share it
• Age Verification (18 U.S.C. § 2257): All persons depicted in sexually explicit Content were 18 years or older at the time of production, and you maintain required records as mandated by law
• Consent: You have obtained consent from all persons depicted in the Content to upload and share it publicly
• No Infringement: Your Content does not infringe on any copyright, trademark, privacy right, or other intellectual property or proprietary right
• Legal Compliance: Your Content complies with all applicable laws and these Terms

5.4 Content Restrictions

You must not upload Content that:

• Features minors in any context (prohibited under federal law)
• Is non-consensual (e.g., "revenge porn", hidden camera recordings)
• Depicts illegal activities (violence, bestiality, incest, etc.)
• Violates intellectual property rights (pirated content, unauthorized use)
• Contains malware, viruses, or malicious code
• Is spam, deceptive, or fraudulent

6. Intellectual Property

6.1 Platform Intellectual Property

The Platform, including its design, features, software, logos, and trademarks, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 DMCA Compliance

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please submit a takedown notice per our DMCA Policy.

6.3 Repeat Infringer Policy

We maintain a three-strike policy for copyright infringement. Users who repeatedly infringe on copyrights will have their accounts permanently terminated.

8.1 Platform Discretion

We reserve the right, but are not obligated, to review, monitor, remove, or modify any User Content at our sole discretion, without prior notice, for any reason including violation of these Terms, applicable law, or community safety.

8.2 Automated Moderation

We use automated tools (machine learning classifiers, hash matching for CSAM) to detect prohibited content. Automated decisions may be appealed for human review (see Content Moderation Policy).

8.3 Enforcement Actions

Depending on the severity of the violation, we may take the following actions:

• Content Removal: Delete violating Content
• Warning: Issue a formal warning
• Temporary Suspension: Suspend account access for 7-30 days
• Permanent Ban: Terminate account permanently
• Legal Action: Report to law enforcement (e.g., CSAM, criminal activity)

8.4 Appeal Process

If you believe Content was removed in error or you were wrongly suspended, you may appeal through our Appeal Center. We will review appeals within 7 business days.

9. Privacy & Data

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.

By using the Service, you consent to our data practices as described in the Privacy Policy, including:

• Collection of account, technical, and usage data
• Use of cookies and tracking technologies (see Cookie Policy)
• Sharing data with service providers and as required by law

10. Payments & Subscriptions

10.1 Creator Monetization

Eligible Creators may monetize their Content through:

• Premium subscriptions
• Tips and donations
• Pay-per-view content
• Advertising revenue share (if applicable)

10.2 Payment Processing

All payments are processed by third-party payment processors (e.g., Stripe, PayPal). You agree to their respective terms of service. We do not store full credit card information.

10.3 Refund Policy

All sales are final. Refunds are granted only in exceptional circumstances (e.g., technical error, fraudulent charge) at our sole discretion.

10.4 Tax Obligations

Creators are responsible for all taxes (income, sales, VAT) on their earnings. We may require tax documentation (W-9, W-8BEN) for compliance with US and international tax laws.

You agree to indemnify, defend, and hold harmless Pinporn.app, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from or related to:

• Your Content (including infringement, defamation, or violation of rights)
• Your violation of these Terms or applicable law
• Your violation of any third-party rights (copyright, trademark, privacy, etc.)
• False information provided during registration or Content upload

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense. You may not settle any claim without our prior written consent.

These Terms shall be governed by and construed in accordance with the laws of State of California, without regard to its conflict of law provisions.

16.2 Notice and Action Mechanism (DSA Art. 16)

EU users can report illegal content or Terms violations through our in-platform reporting system. We will acknowledge receipt and notify you of our decision within a reasonable timeframe.

16.3 Statement of Reasons (DSA Art. 17)

If we remove your Content or suspend your account, we will provide a statement of reasons explaining the decision, the applicable Terms provision, and your right to appeal.

16.4 Internal Complaint System (DSA Art. 20)

You may appeal moderation decisions through our internal complaint system (Appeal Center). We will review complaints within 7 business days and provide a reasoned response.

16.5 Out-of-Court Dispute Settlement (DSA Art. 21)

16.6 Transparency Reporting (DSA Art. 24)

We publish annual transparency reports detailing content moderation actions, user complaints, and government requests.

17. UK-Specific Terms (Online Safety Bill)

For users in the United Kingdom, the following additional terms apply under the Online Safety Act 2023:

17.1 Illegal Content Duties

We take proactive measures to prevent, identify, and remove illegal content including CSAM, terrorism content, and other priority offenses. We cooperate fully with UK law enforcement (NCA, police).

17.2 CSAM Reporting

We report suspected child sexual abuse material to the Internet Watch Foundation (IWF) and National Crime Agency (NCA).

17.3 User Safety Features

UK users have access to safety features including content filters, blocking/muting tools, and reporting mechanisms compliant with the Online Safety Act.

18. US-Specific Terms

18.1 Section 230 Notice (CDA)

Under Section 230 of the Communications Decency Act (47 U.S.C. § 230), we are not liable for User Content posted by third parties. However, we comply with FOSTA-SESTA amendments prohibiting facilitation of illegal sex trafficking.

18.2 State Age Verification Laws

Users in states with age verification requirements (Louisiana, Arkansas, Utah, Virginia, Mississippi, Montana, etc.) must complete additional age verification steps before accessing adult content.

19. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by:

• Email to the address associated with your account (at least 30 days in advance)
• Prominent notice on the Platform
• In-app notification

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may close your account.

20. Termination

20.1 Termination by You

You may terminate your account at any time through account settings or by contacting [email protected]. Your Content will be deleted after a 90-day grace period.

20.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or applicable law
• We are required to do so by law
• Your account poses a security or legal risk
• You engage in fraudulent or abusive behavior

20.3 Effect of Termination

Upon termination:

• Your right to access and use the Service immediately ceases
• Your Content will be deleted (subject to backup retention and legal holds)
• We are not liable for any loss of data or Content
• Outstanding payment obligations remain due

20.4 Survival

The following provisions survive termination: Content Licenses (for publicly shared Content), Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.

21. Miscellaneous

21.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

21.2 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

21.3 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to any affiliate or successor entity.

21.4 Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and us regarding the Service.

21.5 Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control (natural disasters, war, pandemics, government actions, etc.).

21.6 No Agency Relationship

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and us.
